I ordered Blizzard White's Trial Offer on 10/15/2014. Internet advertisement indicated 2 charges, $1.03 for product trial and $ 3.87 for shipping and processing. These fees were charged to my bank account on 10/16 and 10/17 respectively. I copy pasted their posted "Terms and Conditions of How the Offer Works, Returns and Refund Policy" before leaving their site the evening I ordered. In that document, it states; "(8) days from the date of order processing, unless you decide to take an action to cancel (by calling our customer service center at 888-565-8521 or www.BlizzardWhite.com), we'll conveniently bill your credit card $94.31 for the full 30 day BlizzardWhite System." I received a confirmation email from Blizzard White 10/15/2014 stating "Thank You for Your Trial Order. Congratulations! Your Web-Only Trial has already been rushed to you." This document also had a copy of "Terms and Conditions of How the Offer Works, Returns and Refund Policy,Privacy Policy and Contact Information". On 10/23/14, I still hadn't received their product, I called their 24hr/7days a week customer service number only to listen to a recording stating their offices were now closed, to please call back during regular business hours Monday-Friday 8-5pm. Because if I waited until morning to call them, it would be past my "trial period". Because their Terms & Conditions stated the trial period was for 8 days FROM the date of order confirmation, that being 10/15, I counted 8 days FROM that date, 15 + 8= 23, and marked my calendar on the 23rd to make sure and call BlizzardWhite if I wanted to cancel. The word, "from", in every contract I have ever read and/or signed, indicates 'in the future' or 'in addition to', which is why I calculated my trial period ending 10/23/14. On 10/23/2014 BlizzardWhite charged my bank account $94.31! Not only had I cancelled my account using their EasyCancel button on their home page. When I saw the charge of $94.31 on my bank account today, I called their customer service number and spoke with John, who said they charged me because my 8 day trial period to try out their product had ended 10/22/2014 and they had not heard from me to cancel my order. I told John that I didn't even RECEIVE my products to try from them until Saturday, 10/25/2014! I said I had cancelled my order with them on the 8th day from my order placed on 10/15/2014. He told me that they consider the date of 10/15/2014 as one of the 8 days! I told him their Terms and Conditions are unclear, do not state the order date is one of the 8 days, he said it was, I referred him to the line and paragraph of their Terms and Conditions, which clearly state 8 days FROM the date of order. If they include the date of order AS one of those 8 days, it is not clear to any consumer reading it. I stated the use of the word "from" indicates "in addition to" or "afterward". To be clear that date is one of the 8 trial days, it should read a client must call them within their 8 day trial period, "BEGINNING" with the date of order, or "INCLUDING" the date of order. THAT would be Truth in Advertising, not "from". He said it is clear in their document as it is. He said there was nothing they could do about the charge of $94.31 as I clearly agreed to their terms of their 8 day trial period. I argued that it was not clear at all and was misleading. I asked him if he got many calls and complaints about this very thing? He did not answer. He then said if I could hold a moment, he would check something out that might help. He came back on the line a minute or so later and said because they value me as a customer, and only want their customers to be happy, he was authorized to credit my bank account 35% of the purchase price. I said I wanted to return all the product to them, the trial AND the Complete System - and have my account credited 100%. He said that was not possible, I clearly cancelled my account AFTER my trial period had ended 10/22/2014. I told him this was still unacceptable as they are obligated to the Truth in Advertising laws. He said I could accept or decline the offered 35% credit and this was all that could be done on my account. Since the 35% represents $33.00, it cut my losses down to $66.21 from $99.21. I am still steamed about their gross malfeasance regarding their "trial period" and believe they should be taken to task by the Federal Fair Trade and anyone else who can bring some power to bear to make them comply with Truth in Advertising. This is such an obvious scam to collect essentially $100 from how many thousands of people who clearly would interpret their syntax as being 8 days following their order date. Is the consumer responsible to double check to be sure companies are using the proper tense words in their disclosures/disclaimers? I suggested to John he notify their legal department to change the word "from' to 'beginning' or 'included in' their description of their trial period in their Terms and Conditions. By doing this, his company would no longer appear to be intentionally lying and cheating people out of their hard earned money by not standing behind their mistaken use of the English language. I hope my complaint helps by adding one more to the heap of other dissatisfied customers of this dishonest company.
