On July 12, 2011, my wife and I attended a presentation at DirectBuy of Sarasota, 7246 16th Street East, Sarasota, Fl. 34243. We had received a 30 day free trial, no risk or obligation advertisement from them.
At the presentation we we indicated that we were interested and at that time we signed the membership contract and gave them our VISA card to check our credit standing and pay for the initial membership. We did this based on the understanding that we could cancel within the 30 day period stated in their advertisement.
The reason we signed that day was because of a statement made by their salesman that we could fill out all the necessary paperwork then and not have to return after the 30 day period.
On July 22, 2011 I sent a letter to DirectBuy indicating that we had researched their offering and found that it did not fit our buying pattern. Would they please cancel our membership agreement and refund our money, based on the advertisement which stated that we had a 30 day period of no risk or obligation.
DirectBuy of Sarasota replied to me that their contract called for a time limit of 72 hours after which we could not cancel and therefore has refused to refund our money.
My wife and I felt were were operating under the terms of the advertisement and therefore the 72 hr. period did not take effect until 12 August.
This looks like a scam to us where they bring you in under guise of a 30 day no obligation, no risk situation. Get you to sign the contract while you are there. Do not give you access to their services for several days before you can review their offering, and then when you try to cancel, come back with a statement saying that "you signed an agreement which says you cannot cancel after 72 hours".
This feels like a "bait and switch" to my wife and I.
