On April 23rd I responded to a Craigs List ad (which I printed off at the time and can forward) for a 4S 16GB white iphone selling for $250. This is the same model that I recently lost. A man by the name of Felix Saenz who had posted the ad agreed to meet me in the parking lot of the TGIFridays in Leesburg, VA so that I could give him the cash for the phone. When I got home (3.5 hours later with traffic) and set up the iphone with the help of a Verizon Wireless rep by phone, I realized that he actually gave me an 8GB iphone 4. I emailed him with the following email:

Hi Felix,

I just got off the phone with Verizon, who walked me through the setup of this phone. You had said this was 16gb 4s iphone but it’s actually only 8gb and not a 4S, but a 4. I’m not sure if you used the phone yourself. Maybe you didn’t even realize what the actual specks were. You have no idea what I've been through in the past week. I was assaulted, robbed and hospitalized in Guatemala. I had to pay a $4000 hospital bill to get discharged. I’m a nurse who works two jobs to make ends meet and to pay off my student loans. I didn’t have the money for a new phone, so shopped for a used one on Craigslist. I can’t use the one you sold me, as I have to have apps on the phone for my part time job that require 16gb. I am asking that you please buy the phone back from me. I’m sure if you had known, you wouldn’t have mislead me. But I’m really stuck now because I’m on call tomorrow for that part time job (sexual assault nurse examiner) and I have to have a working phone. I have zero money to now buy a 2nd one. Can you please give my sister's phone a call? ***-**** I’d really, greatly appreciate it. Thanks.

I got no reply so I contacted my brother who is an attorney for advice. My brother emailed Felix and told him that I was sold a phone that was less than what he had advertised. Felix responded to me with “Sorry for the misunderstanding but a deal is a deal” and attached a photo of a new ad that he had obviously just created, advertising the specs of the phone that I actually received and he cropped the date out of the picture (which I also printed off and can forward). Luckily I had printed off the original ad and scanned it to my brother who forwarded it to Felix and told him he could either return the money or my brother would proceed legally. Felix has made it clear that he has no intention of returning the money.
