Complaint under Section 12 of the Consumer Protection Act, 1986
RESPECTFULLY SHOWETH:
That the Complainant is a resident of (Personal Information Removed) .
That the facts of the present case, in brief, are as follows:
1. That the Complainant had registered on the Opposite Party’s website on 04.06.2013. That the Complainant was misguided by the Opposite Party and forced to make some payments for receiving certain services of the Opposite Party. And that the Complainant made a payment of Rs. 35,276.50/- via his SBI debit card for the same.[Attached herewith is the copy of the invoice in Annexure I].
2. That,the Complainant then lodged a complaint with the local police station on 05.06.2013 [Attached herewith is the copy of the complaint filed as Annexure II].
3. That the Complainant tried contacting the Opposite Party regarding the problem, and that however they responded in a very negligent manner and denied to refund the total amount to the Complainant.
4. That the Complainant even sent a letter dated 03.07.2013 to the Opposite Party demanding a full refund of the amount and stating deficiency in services [Attached herewith is the copy of the letter as Annexure III and its courier receipt as Annexure IV].
5. That the Complainant further states that he finally received a telephonic call on 16.07.2013 from the Opposite Party enquiring about the details of his problem. He then received a message from the Opposite Party on the same day stating that he would be provided a refund only if he had cancelled his orders within 48 hours of purchase, and not otherwise.[Attached herewith is the copy of the message in Annexure V]. That the Complainant duly sent a mail to the Opposite Party within 48 hours with the relevant details on the same day. Attached herewith is the copy of the mail in Annexure VI].
6. That,the Complainant received an e-mail from the Opposite Party on 19.07.2013 stating that they will be able to refund only 40% of the total amount as opposed to the full amount.[Attached herewith is the copy of the same in Annexure VII]
7. That the Complainant did not receive any response from the Opposite Party after repeated follow ups through calls and e-mails.
8. That this Hon’ble Forum has got pecuniary jurisdiction to entertain this Complaint as the compensation claimed does not exceed Rs. 20,00,000/-.
9. That this Hon’ble Forum has got the jurisdiction to adjudicate as the cause of action arose in Durg, consequently matter falls within the territorial jurisdiction of the forum.
10. That, the cause of action is continuing till date as the Opposite Party has not taken any action on the Complainant’s grievance. Therefore, the complaint is within the limitation period.
11. That the Complainant has not filed any such or similar complaint against the Opposite Parties herein, with respect to the same cause of action, in any other court of law. No such or similar complaint is pending adjudication before any competent court of law.
In view of above stated facts and circumstances it is respectfully prayed that this Hon’ble Court may kindly be pleased to:-
i) direct the Opposite Parties to apologize for all the inconvenience caused to the Complainant;
ii) direct the Opposite Parties to refund the entire amount paid for the package to the Complainant;
iii) direct the Opposite Parties to pay a sum of Rs. 20,000/- towards the mental agony suffered by the Complainant; and
iv) direct the Opposite Parties to pay a sum of Rs. 1,000/- towards cost of this petition;
v) or any such orders and reliefs deemed fit and proper by this Hon’ble Forum in view of the facts and circumstances of this case.
for which act of kindness, the Complainant shall, as is duty bound, ever pray.
