Over one year ago, in November 2012, I first learned of the consignment store Jades Addiction. I brought in a large amount of items for the store to sell for me including name brand clothes and accessories (all in very good condition). I was given a hand-written contract which states Number of Items: 13 Accessories, 42 Clothes/Shoes/Belts 45% to consignor. Since the store had not yet opened, I was given an extended contract through 4/1/13, at which time I would need to pick up my remaining clothes that were unsold. We made a verbal agreement that none of my items were to be donated after this contract expired.

At the end of March 2013, I visited the store to pick up my items. There were only a few items of mine left in the store at that time. The owner informed me that she had my other items in storage and would bring them into the store in the fall, with an ending contract date of 11/31/13. I returned on 11/27/13 and spoke with the store owner (Kelly) in person. She told me I had no balance on my account and I had no items left in the store to pick up. She said that she also sells items on Ebay (that were supposed to be sold in the store). This was never a part of our agreement or contract and I did not give permission for her to sell my items on Ebay (or in any other capacity besides the consignment store itself). I asked Kelly if the consignor was still eligible to receive 45% of the sale price of Ebay sales, and she verbally told me yes and that I would receive the same percentage of the sale proceeds.

I expressed that I was unable to calculate how I had no balance on my account and no items left for pick up, based on the large amount of items I had originally brought into the store. I asked Kelly for an inventory list which provides the item descriptions and prices of my items that have sold in the store. Kelly agreed to email me this inventory during the week of 12/1/13, which I still have not received. She has told me she would pick up the remainder of my clothes from storage.

I believe the store owner has either sold my items and refuses to give me the money which I am owed or still has possession of my items which she refuses to return.
