I placed an internet order for an aircraft altimeter with Proviation Ltd on 27th September 2013. Their web site listed and continues to list the item as being in stock. The item was paid for using PayPal and the order acknowledged with a reference number.

Having failed to provide the item and becoming increasingly concerned about their continuing excuses for non-supply, I notified Proviation Ltd on the 21st November 2013 that I was cancelling the order under the provisions of The Consumer Protection (Distance Selling) Regulations. I also requested a full refund of the sum paid; £244.00.

Proviation Ltd was reminded on the 20th December 2013 that the maximum refund period of 30 days had passed without a refund being made. Promises of a refund have remained unfulfilled. Consequently a claim was issued in the Northampton County Court on 27th January 2014 which has remained unpaid and therefore, a judgment issued against Proviation Ltd on the 19th February 2014. I have no doubt that a warrant will have to be issued in due course.

You should also be aware that an Internet research shows an avalanche of similar incidents and complaints against this company; just look at some of the many examples on these sites:

Furthermore, examination of the Proviation web-site : wwwproviation.com deceives potential customers into believing that the company is to be trusted by displaying the approved trusted services logos of several organizations. Please research these for yourselves because you will find that Proviation are suspended from the Trusted Shops organization and that the Association of European Aviation Suppliers is bogus with only one member; Proviation Ltd and was founded by and is run by Mr Nick Ross, director of Proviation Ltd!

The good news is that the small claims process is easy, allows you to add all claims costs, and even interest at 8% pa.
