I have been a resident at the Midtown Oaks Avesta apartments in Jacksonville Florida since around 25th of november of 2013 I paid my rent late once and had no problem paying the one hundred dollar additional fee and I notified the staff/mgr. that I was going to be late and I paid exactly on the date I specified to the staff/mgr. Now in July on the 7th 2014 I notified the staff/mgr that I was going to pay the rent on the 25th of july 2014 and was told the next day its protocol that a 3 day notice will be placed on but if the MGR had an issue with then I will be notified. On the 18th of July 2014 I was retrieving my mail at the mail box and the mgr. saw me and asked if I can come into the office to discuss my rent. I then explained to the manager that on the 7th I advised the assistant manager whom was present in the office listening to our conversation that I was going to pay my rent on the 25th of July 2014 acknowledging I will have to pay the hundred dollar late fee. I also explained to the manager that I was told by the assistant manager whom was present during this converstion that if this would be a problem I would be notified by the manager. The manager then said to me "we just had a meeting regarding late rent and Im not going to be able to allow you to pay your rent on the 25th of July 2014 you have til the 21st of July 2014 and if you do not pay on the 21st July 2014 I will submit and process me for eviction". I explained to the manager that is not fair had I been told this on the 7th of July I could have paid my rent before the 21st but due to such a short notice and I get paid on the 24th July 2014 I would not have the money til then as I explained to the assistant mgr. on the 7th July 2014. On monday the manager filed and processed me for eviction I received the notice on my door saturday 26 July 2014 . I was able to get assistance and while trying to meet the requirements that were necessary I would like to add from the 29th July 2014 thru 01 August 2014 the assistant manager and manager to me dragged their feet as if they did not want me to pay what was specified to stop the eviction which was a mentally painful experience. On the 30th of July 2014 I was on my way out the apartment and I saw a Corporate manager whom oversees the property I walked upstairs (above the Avesta Midtwon Oaks ) and I asked May I discuss a concern of mine regarding an Eviction which I was facing. The Corporate manager Listened to me she even checked my Ledger and commented that she didnt see any patterns or reason why I would have an eviction notice but then asked for my name and number and said "I will call you later this afternoon after I have spoken to both the assistant manager and the manager of the property". I also expressed other concerns I had as well. On 01 August 2014 with assistance I met the requirement and my rent was paid. I feel my tenant rights were violated because I advised the assistant manager on the 07 July 2014 that I was going to pay late and specified the date 25th July 2014. It was not until the 18th of July I was advised by the manager whom just had happen to see me at 1645 by the mailbox that if I do not pay by the 21st July 2014 she will submit and process me for an Eviction. I want to add mgmt/staff never had one problem with me since my lease began. I feel this action was unjust and not reasonable and affected my life mentally and caused me to feel no welcome at the Avesta Midtown Oaks in Jacksonville florida.
