i AM A VETERAN WITH MENTAL A DISABILITY (Bi-Polar), I AM ON SOCIAL SECURITY. i AM 61 YEARS OLD AT THE PRESENT. On 4-1-09 I HAD MY CAR TOWED TO MR MACIAS AUTO REPAIR TO REPAIR MY TRANSMISSION. HE CALLED ME AND TOLD ME THAT HE COULD REPAIR MY TRANSMISSION BUT THAT MY CAR A 1993 MERCEDES BENZ 400E NEEDED A NEW WIRING HARNESS TO MAINTAIN THE ENGINE RUNNING PROPERLY. I TOLD HIM THAT I COULD ONLY PAY HIM ON PAYMENTS AND HE AGREED. ON ON 4-1-09 I SENT HIM $700. AND HE CLAIMED THAT MY TRANSMISSION NEEDED TO BE REBUILT BECAUSE MY REVERSE GEAR WAS BUSTED AND THAT I WOULD NEED A NEW FUEL PUMP PLUS A NEW WIRING HARNESS. SO I AGREED AND CONTINUED TO SEND HIM MONEY....BUT DUE TO MY MENTAL DISABILITY AND DUE TO THE FACT THAT I WAS SUFFERING TREMENDOUS MENTAL ANGUISH DUE TO MY TWENTY SIX YEAR OLD SON DYING OF LEUKEMIA ON FEBRUARY 7th 2007, I BECAME OUT OF TOUCH WITH REALITY AND MY MECHANIC BUT AS TIME WENT BY I SENT HIM MONEY ON 4-1-09 $700/ 5-1-09 $300/9-1-10 $500/8-10-10 $400/9-29-10 $500/1-5-11 $125/ 2-5-11 $150/ 3-7-11 $120/ 3-9-11 $120/ 4-11-11 $200/ 6-8-11 $250 Totaling $3365.
I TOLD MR MACIAS THAT WHEN I BOUGHT THE CAR ON DECEMBER 2005, A FEW DAYS AFTER THAT DATE MY SON WAS DIAGNOSED WITH LEUKEMIA AND MY ENGINE HAD BLOWN UP (no good anymore and i needed a new engine). So i did not transfer the car title to my name because the car did not run and i was so overwhelmed with my son dying of Leukemia soon after my son died on 2-7-7... I became very sick mentally. I lost all my belongings including the car title that I had not transferred to my name. Later I paid a place by the name of C&E Auto Parts $1985.75 to install a used engine and very soon after that I discovered that I had lost my title and the transmission failed me so I parked the car until 4-1-09, that was when I had the car towed to Mr Macias. He told me that he would help me get another title since the previous owner was being uncooperative in helping me get an another title. He charged me $125 to get the title and he never did it. On April 1, 2011 when I paid him $200, he told me that I did not owe him any more money but that I could not take my car because he still could not get the title (later on my brother made me realize that Mr Macias was lying to me because he was scamming ME!). ON APRIL 8th,2011, I suffered a major heart attack and requiring open heart surgery..on June 8th,2011 I went to see Mr. Macias and he still did not have my title and would not let me take my car home. I paid him $250 for 5 tires and wheels from another car like mine that he claimed he had bought for parts this included an antenna and antenna motor and a trunk locking mechanism and the power steering pump from his junked car...he never installed those parts...about three months ago i started visiting his shop with (personal information removed) and we kept pressuring Mr. Macias to give me my car but each time he had some lame excuse as to why i could not take my car, so finally brother got very upset and told him that had taken advantage of me long enough and demanded for him to release my car and he finally did. He had it towed to my house and charged me $80 for the towing and refunded $170 from the $250 for the parts he did not install. So I bought another battery and bought two tires and finally started my car and it was just as I suspected...HE DID NOT INSTALL A NEW WIRING HARNESS NOR DID HE INSTALL A NEW FUEL PUMP AND MY TRANSMISSION LEAKED ALL THE TRANSMISSION FLUID AND OF COURSE REVERSE GEAR DID NOT WORK! I can substantiate all this by having a certified mechanic inspect my car and document it. Also all the time that was car was in his possession he had it parked on the street and some thug broke my front passenger window and stole my Alpine CD player and caused over two thousand dollars damage to the interior of my car all this Mr Macias claimed he was not responsible for. Also my car was in excellent condition paint wise and being exposed to the elements all this time my roof, hood and trunk paint faded tremendously that I will have to have these items repainted. The car has a sentimental value to me and I do not want to get rid of it and by investing time and money on Mr Macias to fix my car...All he did was take advantage of me, A Vietnam War Era Veteran with a mental disability on Social Security and then to make matters worse after having committed the fraud he knew I had severe heart problems on continued to antagonize me with his lies causing ME severe mental stress and anguish. I believe he has violated my rights as a disabled Veteran by taking my money and not fixing my car. Sincerely Oscar David Fasci (Personal Information Removed) $3000 for I paid him for repairs not done, $2000 for damages due to my car getting broken into and $2000 for repainting my roof, hood and trunk. Total $7000
