The manager said I could have a refund of $399.38 I prepaid for tires and services that I never accepted, but I have not been able to get the refund.

I had been a satisfied customer of Tiremax in Livingston for several previous years so I didn't think I would have any problem with them when on 1/4/12 I pre-paid by Mastercard debit card signature purchase for tires that were not immediately available in the store. Sadly, I discovered that the store is under new management and the level of customer service I had come to expect from them no longer exists. The $399.38 I paid on 1/4/12 also included installation and balancing of the new tires, and disposal
of the old tires, absolutely none of which has happened and the old tires are still on my vehicle. The following day, the store wanted to install a tire that was DOT date stamped older than I wanted installed as a "new" tire. John Crenshaw told me that I could have a refund if that was what I wanted, because he could not personally
guarantee the DOT date of any of the tires he sells, but he was going to try to get me newer tires, and he asked me to return to the store on the afternoon of 1/6. This would have been perfectly acceptable to me, but then the owner or "CEO" of the store (Chris) called me on the phone on the morning of 1/6 and actually screamed at me and used profanity at me for questioning the date on the tires. At that point I decided that I absolutely WOULD NOT buy tires from this store, not now, not ever. So, I returned to the store the afternoon of 1/6 and John Crenshaw was not there. Chris should be proud to learn that I did quite interestingly get an almost verbatim "dressing down" (without the profanity) from Luron about my audacity in questioning the DOT date stamp on tires as I had received on the phone that morning from Chris. Fascinating how they all memorized that same script. Luron also stated that they were too short handed to be able to put the tires on that day, (even if I had wanted to take them, but I wanted the refund), anyway. And I was told by associate Luron that "only John knows how to put in a credit card refund". I found this to be curious because Luron has worked there for a reasonably long time, and being left (apparently) "in charge" of the location, one would think he would know how to operate the cash register. Luron told me to come back the following morning, so I went to the store again on 1/7 at approximately 9 a.m. and John Crenshaw was not there. Luron told me to "come back in a couple of hours" so I returned to the store at approximately 11 a.m. , but again, John Crenshaw was not at the store, and this time I was told that they didn't know when he would be available. So even though John told me that I could have a refund if that is what I wanted, John has not been available to do it, wherefore, TIRE MAX LIVINGSTON TX accepted the returned merchandise/cancellation of services on 01/05/12, and failed to issue the refund. The
drive to the store is 20 miles each time, I have already been there three times, trying to get the refund for merchandise and services that I HAVE NOT and WILL NOT BE receiving from them. In the meantime I have been reading other consumer complaints that I have since found published elsewhere on the internet about Tiremax, and this seems to be the new m.o. for this business. They don't provide the expected tires or service and tell you that you can get a refund and then simply become "unavailable" to provide it so that you have to jump through hoops to get it back.

Update: 01/18/2012

On 1/14 another Mastercard rep did a 3 way call with Tiremax Livingston so I could give John C. my card number so he could process a refund. STILL NO REFUND APPEARS ON MY ACCOUNT.

Update: 01/24/2012

After 16 days, three visits to the store and 2 phone calls and they finally refunded my credit card for the full amount on 1/21/12.

  • Tiremax provided the product exactly as Ms Jamie Garner wanted. However she likely could no longer afford her purchase and wanted a refund which Tiremax did refund her money. Tiremax will be seeking damages in a court of law against Jamie Garner for her false slanderous statements made as we have all on audio/video. Tiremax has never charged anyone for products they did not receive. As you can see from the title false advertising has nothing to do with a refund which Ms Jamie Garner did receive.

  • Sounds exactly like what Tire Max did to some friends of mine a while back, but they paid over $2000 and never got what they paid for. But they had to wait a LONG time to get their money back. Months I think. Sounds like maybe they just hit up their customers for interest free loans every once in a while. Sorry that happened to you and I hope you get your money back.

  • I see in comments that they threatened to sue me for making a complaint. I kind of hope they do, because it will save me the filing fee. Also their own audio/video evidence (if they really have any) will show me not receiving tires and not receiving a refund, and will support my counter suit. Also, truth is an absolute defense to defamation, so that would be just perfect! Thanks Tiremax!

    Somebody apparently forgot to take their meds, because in a different communication Tiremax said that I could call with my card number and they would issue me a refund. Mastercard told me that they don't need my card number to process a refund, that it can be done from the original purchase transaction. But the helpful, courteous, kind and cheerful service rep from my Mastercard dispute resolution department tried to call Tiremax this morning to assist them to facilitate the refund, since they apparently need help with that part. But golly gee whiz. The guy at Tiremax who knows how to do that wasn't there. Surprise, surprise.

    Tiremax was right about one thing, though. I probably should not have selected “false advertising” when I filed this complaint. It probably belongs under the category of “other scams”, but I didn't see that selection was available when I filed the complaint. Oh darn, eh? I selected false advertising because it seemed more appropriate than the available categories that I did see. Although in a round about way advertising tires for sale and then not providing them in exchange for money is kind of false advertising.

    No I have not yet received my refund. But I will.

  • On Saturday morning 1/14, a second Mastercard dispute resolution representative facilitated another 3 way call with Tiremax, Livingston and we gave the guy my card number so he could process a refund. It was funny because after we were done, the Mastercard rep said "We aren't going to just take his word for it." Sure enough, STILL no refund appears on my account. To date, Tiremax is still just a band of liars of thieves. I can't believe that Chris Wilkerson (the owner, ceo, or whatever he calls himself this week) is really just stupid enough to believe that I am just going to let him have almost $400.00. Duh!
