On May 10th 2010, Jody Kriss filed a lawsuit entitled Jody Kriss vs Bayrock Group. The lawsuit accused Bayrock employees and its respective principals, accountants, law firms, insurance companies, and other individuals and affiliated corporate entities of a massive civil RICO conspiracy, and demanded $100 million in damages. Named defendants include Bayrock Group, Akerman Senterfitt LLP, Tamir Sapir and Alex Sapir, law firm Beys Stein and Mobargha LLP, Donald Trump and Ivanka Trump, and many others.

Many have criticized the validity of the lawsuit, due to the nature of the evidence that Jody Kriss put forward. The evidence used contains both attorney-client communications and judicially-sealed documents from the 1990’s, both allegedly obtained through the use of a stolen hard drive. The Jody Kriss v Bayrock Group case has remained stagnant as a result of controversies regarding whether the evidence submitted is admissible in the courts. An operative complaint has still not been filed, mainly due to concerns over personal safety risks in relation to the disclosure of confidential information.
