I was in my third modification process. I complied daily to their specifications through numerous communications, giving them full cooperation. I have thorough, detailed confirmation and evidence for every step of this process showing that I furnished them all paperwork requested. I did not hear from them so I listed my home for sale as a backup option in case the modification was not successful. It went into escrow on 2/28/11 (less than a 30 day escrow). My agent notified B of A that my home was listed. They did not acknowledge the sale until 3/1/11. They then related it was too late. B of A sold it on a trustee sale. I lost over $20,000.00 in equity. My true loan balance was $231,000.00 plus $20,000.00 equity. I am seeking $299,000.00 in restitution for suffering the needless loss of my home and the loss of my excellent credit rating.
