In June, 2011, I applied to USBank for a refinance of my current home mortgage, which they held. I was assisted by Chad Pearce of USB. Initially, Mr. Pearce told me there would be no problem with my refi and that I wouldn't have to come up with any extra costs beyond normal closing costs. However, after the appraisal was finished, I was informed by Mr. Pearce that I would have to either bring an additional $4,800 to closing, OR that I would have to take a "second" mortgage on my property.

I am a retired person, on a limited income. I had been making my payments of over $870 per month, for 6 years to USBank, without one late payment or any penalties or extra interest. In other words, I have been an exemplary client! My purposes for a refi were to 1) bring down my payments a bit and 2) so I could start a savings account. I wanted to make sure that I was able to continue my mortgage payments in the same exceptional manner as I had already established as well as have a savings account. By the way, my credit rating is an excellent 789!

Mr. Pearce told me initially that my appraisal fee was $315 and that I would have to deposit a $500 sum; and further that anything over the $500, I would be refunded. Mr. Pearce also said that there was a "non-refundable application fee" for which I was charged another $465 on my MasterCard. Mr. Pearce did not indicate that there would be any possibility of a denial of my application, nor what the disposition would be of that $465 charge in that event.

After Mr. Pearce told me that I would have to bring $4,800 to closing or take out a second mortgage, I decided that I could not afford to continue with their loan process. The two mortgage payments would not have saved me any money and, in fact, would have just made my debt more complicated.

Thereafter, USBank sent me a "Statement of Credit Denial, Termination, or Change" - dated in two places; on top on June 15, 2011 and at the bottom on June 23, 2011. I wrote USB on July 7, 2011, cancelling the application and demanding repayment or credit back to my MasterCard of the $465 which apparently was the "application" fee. It is my position that since USB cancelled my application, they owe me return of the application fee.

USB, through Mr. Pearce, lied to, deceived me, and made statements they had no intention of standing behind.

To date, I have had no response, whatsoever, to my July 7, 2011 letter!

I have tried to locate the Kentucky Attorney General to file a complaint, but have been unable to locate through the internet. If you cannot help me, perhaps you can provide me with the address of the Kentucky Attorney General.
